Jack Link’s Jerky Cologne Sweepstakes (“Sweepstakes”) Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING

Eligibility/Sweepstakes Period: Legal residents of the fifty (50) states of the United States or Washington D.C., 18 years of age or older (19 years of age or older in Alabama and Nebraska, 21 years of age or older in Mississippi) are eligible for this Sweepstakes. Sweepstakes begins at 9:00:00 a.m. Eastern Daylight Time (“CDT”) on 4/01/2021 and ends at 11:59:59 p.m. CDT on 4/04/2021 (“Sweepstakes Period”). Employees of Link Snacks Inc. (“Jack Link’s” or “Sponsor”), Marketing Incentive Resources, Ketchum, their respective affiliates, subsidiaries, distributors, sales reps, advertising and promotion agencies and suppliers of promotion materials, and the members of the immediate families and households of each (whether or not related) are not eligible to enter or win. Void where prohibited by law.

How To Enter: To enter the Sweepstakes, you’ll first need to become a registered user of www.Instagram.com (“Instagram”) or Instagram account. If you do not have an account, go to www.Instagram.com to create one. Instagram accounts are free. By submitting your information and creating an Instagram account, you agree to the Instagram Terms of Use and Privacy Notice. If you do not agree to such Terms of Use and Privacy Notice, you cannot create a Instagram account, or participate in this Sweepstakes. Additionally, to enter via Instagram, you must be a follower of @jacklinksjerky.
During the Sweepstakes Period, look for the Sweepstakes announcement (“Sweepstakes Announcement”) on Sponsor’s Instagram (@jacklinksjerky). To enter the Sweepstakes, you must follow @jacklinksjerky, “like” the Sweepstakes Announcement, comment on the Sweepstakes Announcement and tag two additional Instagram users on the Sweepstakes Announcement.

By following, liking, and commenting to enter the Sweepstakes, you affirm that you have read, understood and agreed to these Official Rules. Entrants understand that they are posting at their sole risk. Sponsor is not responsible for any claims arising from a post, specifically including, but not limited to, claims for intellectual property infringement and privacy rights violations, as well as violations of the respective social media site’s terms and conditions.

Entries that are incomplete or generated by script, macro or other automated or mechanical means, that have been submitted through illicit means or by any means which subvert the entry process or that do not conform with or satisfy any or all of the conditions set out in the Official Rules will be void. Multiple entrants are not permitted to share the same social media account or email addresses. Sponsor reserves the right to waive the entry requirements in its reasonable discretion.

Automated online entries are prohibited. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the sweepstakes or by any technical or human error which may occur in the processing of the entries in the sweepstakes. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Sweepstakes entries) who tampers with the entry process. By entering, entrant agrees to abide by and be bound by these rules and decisions of Sponsor and Marketing Incentive Resources, an independent promotion administrator whose decisions are final and binding in all respects. In the event of a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. Entrants may not participate under multiple identities. Any entrant who attempts to enter under multiple identities or uses any other device or artifice to enter multiple times will be disqualified from participation in the Sweepstakes and all entries submitted by that entrant will be void.

Prize: One (1) Grand Prize. One verified winner will receive a Jack Link’s Jerky Cologne Set. Approximate Retail Value (“ARV”) is $40.00. ARV is as of date of printing of these Official Rules. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded. All prize details including, without limitation, the size and color, shall be determined by Sponsor in its sole discretion.

Winner selection: The potential winners will be selected in a random drawing to take place on or about 04/04/2021 from among all eligible entries received throughout the Sweepstakes Period. Odds of winning are dependent on the number of eligible entries received. By accepting the prize, winners waive the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize.

Winner notification: On or around 04/04/2021, potential prize winners will be notified by direct message or a comment response via the social media platform used for entry. Potential winners are subject to verification. Prize winners will be required to sign and have notarized an affidavit of eligibility, a release of liability, and where permitted, a publicity release within seven (7) days of the date on the notification or the prize will be forfeited and awarded to an alternate winner. If a potential winner is found not to be eligible or not in compliance with these Official Rules, if attempted notification or any prize is returned as undeliverable, if any required documents are not returned within the required number of days, if a winner cannot be verified, or if a winner is otherwise unable or unwilling to accept and claim the prize as stated, then such potential winner may be disqualified and Sponsor will have no further obligation to such potential winner. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.

Sweepstakes is subject to all applicable federal, state and local laws and regulations. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Prize is nontransferable, except as provided herein, and not redeemable for cash. No prize substitutions allowed except by Sponsor, who may substitute a prize of comparable or greater value if the advertised prize becomes unavailable. All federal, state and local taxes on the prize are the sole responsibility of the winner who will receive a Form 1099 for the actual retail value of the prize received. Please allow 4-6 weeks for shipment of prize winner verification.

By entering, entrants agree (and agree to confirm in writing, if asked): (a) to release Sponsor, Marketing Incentive Resources, Ketchum, Facebook, Inc., & Instagram, and each of their respective parent companies, affiliates, subsidiaries, distributors, sales reps, advertising/promotion agencies and suppliers of promotion materials, and the employees, contract workers, officers, directors and agents of any of the above organizations from any and all liability for any injuries, losses or damages to any person (including but not limited to the risks of travel and/or death) and to property of any kind caused in whole or in part, directly or indirectly, by participation in the sweepstakes or the awarding, acceptance, receipt, possession, and/or use or misuse of a prize ; (b) under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby knowingly and expressly waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses and/or any rights to have damages multiplied or otherwise increased; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred (if any), excluding attorneys’ fees and court costs.

By accepting a prize, the winner agrees to Sponsor’s and its designees use of his/her name, photograph, likeness and/or statements made by the winner regarding the Sweepstakes and Jack Link’s for advertising, publicity and promotional purposes in the U.S. without limitation and without further compensation, except where prohibited.

Sponsor is not responsible for lost, late, misdirected, undelivered, incorrect, or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, bugs, virus, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor will award the prize from among all eligible, non-suspect entries received prior to cancellation in a manner deemed fair and equitable. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions, the website, or network connections that are human or technical in nature. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process, the website, or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

If you are selected as a winner, your information may also be included in a publicly-available winner’s list.

For the name of the winner, send a self-addressed, stamped envelope to: Jack Link’s Jerky Cologne Giveaway Sweepstakes Winner’s Name, One Snack Food Lane, PO Box 397, Minong, Wisconsin 54859. Requests must be received by 12/31/2021.

GOVERNING LAW: By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the sweepstakes shall be governed by, and construed in accordance with, the laws of Minnesota, without giving effect to any choice of law or conflict of laws rules.
