Spot the WILD Billboard Contest

Official Rules

 

NO PURCHASE NECESSARY.  A PURCHASE WILL NOT INCREASE THE CHANCES OF WINNING.  VOID WHERE PROHIBITED BY LAW.  ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY.

 

1. Eligibility: Spot the WILD Billboard Contest (the “Contest”) is open to Texas residents 18 years of age and older as of April 27, 2024. Proof of age and identity must be furnished upon request. Employees, agents, independent dealers, and affiliates of Sponsor (identified below) and its agents, affiliates, and immediate family members of all such persons, are not eligible to participate in the Contest. Sponsor reserves the right, at its sole discretion, to cancel, terminate, suspend, or amend this Contest at any time for any reason. Sponsor further reserves the right to amend these rules (“Official Rules”) at any time without prior notice, at its sole discretion. Sponsor reserves the right to disqualify any participant for any reason, including, but not limited to, violation of these Official Rules, copyright infringement or infringement of the rights of a third-party.

 

2. Agreement to Rules: By submitting an entry, participant agrees to be fully and unconditionally bound by these Official Rules and represents and warrants that he or she meets the eligibility requirements set forth herein. In addition, participant agrees to accept the decisions of Sponsor, as final and binding as they relate to the content and the Contest. The Contest is subject to all applicable federal, state and local laws. Persons submitting incomplete entries or entries under false pretenses will be disqualified.

 

3. Contest Period: Entries will be accepted online starting on April 27, 2024 at 12:01 AM CST and ending at 11:59 PM CST on the date Sponsor’s Billboard (pictured below) is removed from public display. All online entries must be received during the Contest period.

 

4. How to Enter: Entry does not require a payment or purchase of any kind. To enter the Contest, a participant must have a TikTok account. If you do not have a TikTok account you may create one for free by visiting www.tiktok.com. By submitting your information and creating an account, you agree to the terms of use and privacy policy of TikTok. If you do not agree to the terms of use and privacy policy, you cannot create an account or participate in the Contest. Sponsor may not receive entries from TikTok users with “private” updates (i.e., a participant has set his or her account so that only people the participant has approved can view his or her updates.) If a participant is using his or her mobile device to submit an entry, charges, including message and data rates, may apply. Participants should consult their wireless service provider regarding its pricing plans.

 

Beginning April 27, 2024, Sponsor will erect a billboard along a public roadway, displaying the following image:

(“Sponsor’s Billboard”). Participants may enter the Contest by: (a) following Sponsor’s TikTok account on its TikTok page at https://www.tiktok.com/@jacklinkswild; (b) locating the Sponsor’s Billboard or a delivery van bearing the same image; (c) creating and posting a TikTok video displaying a selfie that includes an image of the participant with the Sponsor’s Billboard or the delivery van bearing the same image; and (d) tagging Sponsor’s TikTok account on the video. Limit one entry per unique TikTok account. Duplicate entries from the same TikTok account, email address, or person may be eliminated without notice to the participant. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. Entries that are incomplete, garbled, or corrupted are void and will not be accepted.

 

Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Entries that violate these entry requirements, as determined by Sponsor in its sole discretion, will be disqualified from the Contest.

 

5. Prize: There will be one winner who will each receive a prize pack consisting of Jack Link’s WILD meat sticks, and a Jack Link’s WILD branded tank top, fanny pack, and headband. The total approximate retail value (“ARV”) of the prize for the Contest is $100.00. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Any costs and expenses associated with prize acceptance and use not specified herein as being provided are the winner’s sole responsibility. Acceptance of prize constitutes permission for Sponsor to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

 

Prizes are awarded “as is” with no guarantee. All warranties, whether express or implied, including the warranties of merchantability and fitness for a particular purpose, are hereby disclaimed by the contest parties.

 

6. Odds: The odds of winning depend on the number of eligible entries received.

 

7. Winner Selection and Notification: The potential winner of the Contest will be selected in a random drawing under the supervision of the Sponsor conducted within five (5) days following the end of the Contest period. Potential winners will be notified via direct message (DM) within five (5) days following the selection. Sponsor shall have no liability for a potential winner’s failure to receive notices due to any reason. If the potential winner cannot be contacted, is ineligible, fails to claim the prize within five (5) days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases, as required, prize may be forfeited, and an alternate winner may be selected in a random drawing, at Sponsor’s sole discretion. To accept and receive the prize, the potential winner must provide personal and contact information to Sponsor, including proof of age, full name, and address, and execute any other documents specified by Sponsor, in its sole discretion, by the deadlines specified.

 

The participant must be the rightful owner of the TikTok account used to enter the Contest. Participants may be requested to provide the Sponsor with proof that the entrant is the authorized account holder of the TikTok account name associated with the entry. In the event of a dispute as to the identity of a winner, the winner will be deemed to be the natural person in whose name the applicable TikTok account is registered. In the event of a discrepancy between the identity of the authorized account holder, the “winner,” and the participant, Sponsor reserves the right, in its sole discretion, to determine whether the entry is valid or to declare the entry invalid and select an alternate winner.   

 

The receipt by winner of the prize offered in this Contest is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

 

For the name of the prize winner, send a self-addressed, stamped #10 envelope to: Link Snacks, Inc., 600 Hennepin Avenue, Suite 120, Attn: General Counsel’s Office, Minneapolis, MN 55403. Requests must be received no later than sixty (60) days after the end of the Contest period.

 

8. Rights Granted by Participant: By entering, participant agrees that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, participant’s entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Contest, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

 

9. Terms: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify, or suspend the Contest should (in its sole discretion) a civil, environmental, or public health emergency, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Official Rules.

 

Any attempt by a participant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

 

10. Limitation of Liability: By entering this Contest, participant agrees to release and hold Sponsor, its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, as well as any entity associated with the brands comprising the prize, (the “Released Parties”), harmless from any and all losses, damages, rights, claims and actions of any kind (including attorneys’ fees) arising out of or in connection with the Contest, the participant’s participation in the Contest, or the acceptance, use, or misuse of any prize, including without limitation, personal injury, death and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Released Parties are not responsible for errors or difficulties of any kind whether human, mechanical, technical, electronic, computer, network, typographical, or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes, or in any Contest-related materials. In addition, by participating in this Contest participant agrees to a complete release of TikTok of any claims.

 

11. Disputes: This Contest is governed by the laws of the State of Minnesota, without respect to conflict of law doctrines. As a condition of participating in this Contest, participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Hennepin County, Minnesota. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest), and participant further waives all rights to have damages multiplied or increased.
